Scope
These terms and conditions of sale apply to any order placed on the website by a natural or legal person, hereinafter “the buyer”. Placing an order implies their unreserved acceptance. They take precedence over any other document.
The seller may change them at any time: the applicable version is the one in force on the date of the order. The provisions on the right of withdrawal and the legal guarantees apply to buyers who are consumers.
Products
The products offered are those presented on the website, while stocks last. Each product page describes their essential characteristics. Photographs are as accurate as possible but cannot guarantee an identical appearance, particularly for colours.
Second-hand candle holders. Vintage candle holders (Nagel, BMF, Quist and others) are original period pieces. They may show signs of use or a patina, described and photographed on the product page. As these characteristics are brought to the buyer’s attention before purchase, they do not constitute a lack of conformity.
If an ordered product turns out to be unavailable, the seller informs the buyer as soon as possible and refunds the corresponding amounts.
Prices
Prices are shown in euros, all taxes included. The seller is covered by the VAT franchise scheme: VAT not applicable, article 293 B of the French General Tax Code.
Shipping costs are added to the price of the products. They are detailed on the Shipping page and shown before the order is confirmed. The price invoiced is the one displayed at the time of the order.
Ordering
To order, the buyer:
- adds the chosen products to their cart;
- enters their details and chooses a delivery method;
- checks the order summary and corrects it if necessary;
- accepts these terms and conditions and proceeds to payment.
Confirmation of payment constitutes conclusion of the contract. The seller confirms the order by email. The data recorded by the website constitutes proof of the order and of the transaction.
Payment
Payment is due when ordering, by one of the following methods:
- bank card (Visa, Mastercard), on the secure SystemPay platform of Caisse d’Épargne;
- PayPal, for orders with a total amount of up to 200 €, shipping included;
- bank transfer: the order is then processed once the funds are received.
Bank details are entered directly with the payment provider and do not pass through the website. More information on the Secure payment page.
Delivery
Products are delivered to the address or pickup point given when ordering, within the areas listed on the Shipping page. The usual carriers are Mondial Relay and Colissimo (La Poste).
In-stock products are generally dispatched within 24 working hours after payment is confirmed. Transit times are indicative. Unless a different time is stated when ordering, delivery takes place no later than 30 days after the order. Failing this, a consumer buyer may cancel their order under the conditions laid down in articles L216-6 et seq. of the French Consumer Code.
Parcels are insured against loss, theft and breakage. Risk passes to the consumer buyer when they take physical possession of the products. If a parcel is damaged, they are asked to report it to the seller as soon as possible, with photos.
Right of withdrawal
A consumer buyer has 14 days from receipt of the products to withdraw, without having to give a reason or pay a penalty. They inform the seller of their decision by an unambiguous statement, for example by email to contact@desbougiespournagel.fr or using the form below.
They return the products no later than 14 days after communicating their decision, to the address given by the seller. Return costs are at their expense. Products must be returned complete and in good condition, candles in their original unopened packaging. The buyer may be held liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature and characteristics.
The seller refunds all amounts paid, including the original shipping costs (on the basis of the cheapest delivery method offered), no later than 14 days after being informed of the decision to withdraw. The refund may be withheld until the products have been received. The refund is made using the same payment method as the order, unless otherwise agreed.
The procedure is detailed on the Money-back guarantee page.
